aftertestrun to assert.fail

I have a requirement to report a test run failure but it needs to be in the AfterTestRun binding.

I have tried Assert.Fail and tried throwing the exception. The exception gets thrown but the test run still reports back a success. 

Does anyone know any workarounds to report a failure back in the aftertestrun?
